CIRCUIT COURT - DIVISION THREE

NOTICE

Beginning Monday, February 5, 2024, Division Three will officially conduct the Business Court Motion Hour at 10:00 am on Mondays, immediately following the Civil Motion Hour.

Business Court motions are to be noticed for the Business Court Motion Hour.  Further, any Business Court matter that requires immediate attention may appear at any Business Court Motion Hour to be heard briefly. Counsel are still encouraged to communicate with Division Three staff prior to appearing unscheduled at Business Court Motion Hour to ensure case materials are available.

Motion Hour

Mondays:       Criminal – 9:30 am

                        Civil – 9:45 am

                        Business Court – Called at the foot of the Civil Docket

 

Business Court

The Court hears Business Court Motion Hour directly following the call of the Civil Motion Docket and has set aside time following the Motion Hour to address urgent concerns. For scheduling Case Management Conferences and other Business Court matters, please contact Kimberly Lowe.

 

Remote Proceedings

All Criminal matters, including Motion Hour, must be conducted in person. The Court strongly encourages in person attendance for all Civil and Business Court matters as well but does offer a remote option for these proceedings. However, all substantive hearings must be conducted in person. To join proceedings remotely, the parties shall dial into the Teleconference Number, enter the Conference ID, then wait quietly for their case to be called.

Circuit Court is the court of general jurisdiction that hears civil matters involving more than $5,000, capital offenses and felonies, land dispute title cases and contested probate cases. Circuit Court has the power to issue injunctions, writs of prohibition and writs of mandamus and to hear appeals from District Court and administrative agencies.  In Jefferson County, there are thirteen separate divisions, or courtrooms.  Separate judges preside over each division.
